Extending Your Stay in the USA 2026 — Options & Rules

ESTA vs Visa

Extension rules depend on how you entered:

  • ESTA (Visa Waiver Program): CANNOT be extended. You must leave by day 90. The only exception is a rare "Satisfactory Departure" (if you can't leave due to flight cancellation or medical emergency), granted for up to 30 days.
  • B1/B2 visa: CAN be extended using Form I-539. Extensions of up to 6 months are possible if you file before your I-94 expiry.

Form I-539

The I-539 is the application to extend or change non-immigrant status. File it with USCIS before your current admission period expires. Processing takes 2-10 months (slow).

Reasons for Extension

You must give a legitimate, verifiable reason:

  • Medical treatment that couldn't be completed in the original period
  • Extended business meetings or negotiations
  • Family emergency (death, serious illness)
  • Enrollment in a short training course
  • Waiting for travel documents

Weak reasons: "I like it here," "I want more vacation time." These get denied.

Application Process

  • 1. Download Form I-539 from uscis.gov
  • 2. Gather evidence: I-94 (from i94.cbp.dhs.gov), passport, proof of need, proof of funds, proof of return plans
  • 3. File online or by mail with fees
  • 4. Receive receipt notice (I-797C) within 2-3 weeks
  • 5. While pending, you are in "period of stay authorized"
  • 6. Decision within 2-10 months

Overstaying Consequences

⚠️ Serious: Overstaying even 1 day has consequences. Overstaying 180+ days triggers a 3-year re-entry ban. Overstaying 1+ year triggers a 10-year ban. Your ESTA will be cancelled automatically and you will be flagged for future entries.

If you have overstayed, consult an immigration lawyer before leaving — the legal analysis matters.

Alternatives

  • Leave and return — some travelers do "border runs" to Canada/Mexico, but CBP may deny re-entry. Not reliable.
  • Change status — if you have a job offer, apply for a work visa from within the US
  • Return home and apply for a longer visa — often the cleanest option
